THE LANDOWNER AS TENANT
Public-sector bodies and large corporations may have their own communications networks, parts of which may be on property belonging to others. If all or part of the network becomes redundant or needs to be moved, Telemaster may be able to negotiate early termination of the lease or licence document binding the equipment owner, to end the need to pay rent and to enable removal of the equipment. If this is not possible, Telemaster may be able to suggest alternative courses of action to minimise costs, ongoing tenant responsibilities and risk.
On the other hand, where the equipment owner needs to maintain its network, has equipment on another’s property and receives notice to quit, Telemaster can advise on the options available, to include the possibility of and procedures for applying for code powers (largely available to all network and network infrastructure owners/providers since the passing of the Communications Act 2003).
